Just RMA'd my GIGABYTE GPU for a second time, are there chances for a refund?

Got a GIGABYTE Radeon RX 580 Gaming last December, had some issues with it crashing the PC under load (around 85 Celsius at first, 75-78 now, so I doubt it's overheating) that have become more common with time, with a different PSU as well. RMA'd it the first time, got it back without any changes, except now it crashes even earlier. Shot a few videos of it crashing with an AIDA OSD with all stats and sent again. Are there any chances they'll return money for a clearly faulty GPU?

AMD: buy Sapphire or PowerColor, always. Avoid MSI. XFX/ASRock are generally bad. Gigabyte are 50/50. ASUS tax is a scam.
